REPRESENTATIVE AND STUDENT RELEASE OF LIABILITY, WAIVER, AND PERSONAL DATA CONSENT FORM

SCHEDULE 1 - ACKNOWLEDGMENTS

As an authorized Representative, please review the statements below and indicate your acknowledgment and agreement by checking each box. Your acknowledgment ensures compliance with applicable UAE laws and confirms your authority to act on behalf of the Minor Student(s) and their Parent or Legal Guardian.

Legal Authority Confirmation
I confirm that I have obtained all necessary approvals required under UAE law to sign this Release on behalf of the Parent(s) or Legal Guardian(s) of the Minor Student(s).
Explicit Consent for Personal Data
I confirm that I have obtained explicit consent from the Minor Student(s)' Parent or Legal Guardian to provide Emirates Nature-WWF (EN-WWF) with any Personal Data, including Sensitive Personal Data, of the Minor Student(s) as required for participation in the Activities.
Safety Assessments Conducted
I confirm that I have conducted all necessary safety risk assessments regarding the Activities and have approved the Activities as safe and secure for the Minor Student(s) to participate, in accordance with applicable UAE laws and regulations.
Authorization by School and Parent or Legal Guardian
I confirm that I am authorized by the School and the Minor Student(s)' Parent or Legal Guardian to sign this Release and to supervise the Minor Student(s) during their participation in the Activities.
Understanding of Responsibilities
I acknowledge and accept my responsibility to:
- Supervise the Minor Student(s) at all times during the Activities.
- Ensure compliance with EN-WWF’s rules and instructions.
- Contact the Minor Student(s)' Parent or Legal Guardian promptly in the .event of a medical emergency.
Acceptance of Terms
I have read and understood the terms and conditions outlined in the Release provided under Schedule 2 and agree to be bound by them on behalf of myself and the Minor Student(s).

SCHEDULE 2 – RELEASE

- PLEASE READ CAREFULLY BEFORE CLICKING ON ‘I ACCEPT’. THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS AND THE RIGHTS OF THE MINOR STUDENT(S) YOU REPRESENT. YOUR ACCEPTANCE INDICATES THAT YOU HAVE READ, UNDERSTAND, AND ACCEPT THESE TERMS ON BEHALF OF YOURSELF AND THE MINOR STUDENT(S)-

Staff from Emirates Nature Association working in association with Worldwide Fund for Nature (“EN-WWF”) shall be present during the Activities (defined below). It is the responsibility of participants to exercise safety precautions and participate in EN-WWF’s activities at their own risk.

In consideration of being allowed to participate in field activities around the United Arab Emirates, I, as a Representative of Minor Student(s), hereby freely, voluntarily, and without duress execute this Release under the following terms, on behalf of myself and the Minor Student(s) under my supervision.

DEFINITIONS AND APPLICABILITY
1. For the purposes of this Release, the following definitions apply:
  - “Participant” means any individual who attends and engages in the Activities organized by EN-WWF. This includes:
  - “Minor Student(s)” means a student under 18 years of age attending the Activities under the supervision of a Representative.
  - “Representative” means an authorized school representative acting on behalf of a Minor Student.
  - “Parent or Legal Guardian” means an individual who is the parent or court-appointed legal guardian recognized under applicable UAE law of a minor Student(s) attending the Activities with their school Representative.
  - “Privacy Policy” refers to EN-WWF’s Privacy Policy as provided under Schedule 1.
  - “School” refers to name of the school provided by Representative under the Sign Up Form.
  - “Sign Up Form” refers to the online registration form.
2. This Release applies to all Students and their Representatives participating in EN-WWF Activities.
ACTIVITIES. As a Representative of Minor Student(s), I acknowledge that the Minor Student(s) under my supervision will participate in activities that may involve inherent risks associated with outdoor and environmental engagements. These These Activities may include, but are not limited to: kayaking, hiking, beach clean-up, using tools and equipment, carbon offsetting activities, camera trapping, habitat restoration, trekking, scrambling, swimming, diving, snorkeling, overnight camping, boat excursions, edutainment experiences, wildlife and plant monitoring and handling, monitoring water quality, surveying activities, and workshops (online or in person) (collectively referred to as the “Activities”). I further understand that the Minor Student(s) and I shall not be paid for the Activities or for any participant services, and that participation in the Activities may be terminated at any time by EN-WWF for health and safety concerns.
DUTY OF CARE. EN-WWF acknowledges its responsibility to exercise reasonable care and diligence to ensure the safety and well-being of the Representative and the Minor Student(s) under the supervision of the Representative during the Activities. EN-WWF EN-WWF is committed to adhering to recognized health and safety standards and practices appropriate to the nature of the Activities. Further, ENWWF will provide necessary instructions, equipment, and supervision appropriate to the nature of the Activities. Representatives are expected to supervise their Minor Student(s) at all times during the Activities, in accordance with their professional duties and applicable school policies.
SUBSISTENCE. I acknowledge that EN-WWF may not provide any food and beverages during my and my Minor Student(s)' participation in the Activities. I, on my own behalf and on behalf of my Minor Student(s), understand and further acknowledge that it is solely my responsibility to bring any food and/or beverages we require during our participation in the Activities.
ENVIRONMENTAL GUIDELINES. As a Representative, I acknowledge that it is strictly forbidden within the area(s) where the Activities are conducted to engage in prohibited activities such as dumping waste; hunting or harming wildlife; making campfires; destroying vegetation; removing natural or archaeological materials; and introducing alien species, as per the applicable UAE federal and local environmental laws and regulations. I agree to explain these guidelines to my Minor Student(s), with assistance from EN-WWF as needed, and will encourage compliance throughout the Activities. EN-WWF will provide guidance and instructions to ensure all participants understand these obligations.
ASSUMPTION OF RISK. In the event of a medical emergency, I, on my own behalf and on behalf of my Minor Student(s), hereby expressly and specifically assume the responsibility of the risk of injury or harm from participating in the Activities. I understand and acknowledge that I am responsible for following EN-WWF’s rules and the instructions of EN-WWF’s staff and that participating in the Activities is governed by rules and regulations protecting the environment and such Activities may include work that is hazardous, and that participants can suffer property loss or damage, serious injury, or death. I certify that I have thoroughly explained the risks associated with the Activities to the Minor Student(s) Parent or Legal Guardian and have obtained all necessary approvals required under applicable UAE laws and regulations. I hereby affirm that the Minor Student(s) wishes to participate in the Activities nonetheless. By accepting this Release, I expressly and specifically assume all risks of injury or harm from participating in the Activities for both myself and the Minor Student(s). I further acknowledge and agree that it is solely my responsibility as a Representative to supervise my Minor Student(s) during his/her participation in the Activities at all times.
MEDICAL TREATMENT. In the event of a medical emergency involving myself or my Minor Student(s), I acknowledge that EN-WWF will make reasonable efforts to contact the relevant authorities. Furthermore, in the event of a medical emergency involving my Minor Student(s), it is my responsibility to contact the Minor Student(s)' Parent or Legal Guardian as soon as possible.
I confirm that I have obtained all necessary approvals and consents required under applicable UAE law and regulations from the Minor Student(s)' Parent or Legal Guardian to provide EN-WWF with any Sensitive Personal Data necessary to EN-WWF for arranging any first aid or medical treatment.

In accordance with Section 12 below, I release EN-WWF from liability for any reasonable first aid or medical treatment provided in good faith to myself and/or my Minor Student(s), except in cases of EN-WWF’s gross negligence or wilful misconduct. EN-WWF will handle all Sensitive Personal data in accordance with EN-WWF’s Privacy Policy.
INSURANCE. I confirm that I have adequate insurance health and medical insurance coverage for myself. I have confirmed with the Parent or Legal Guardian of my Minor Student(s) that they have adequate health and medical insurance coverage for their child(ren) during their participation in the Activities. I acknowledge that EN-WWF may request a copy of the insurance documentation for the Minor Student(s), and I agree to provide such documentation if requested, in accordance with applicable UAE law and school policies. I understand and acknowledge that, except as otherwise agreed to by EN-WWF in writing, EN-WWF does not carry or maintain health and medical insurance for any Participant.
HEALTH REPRESENTATIONS AND WARRANTIES. I represent and warrant the

  1. I am not currently experiencing symptoms of any communicable disease, including but not limited to COVID-19.
  2. I am not suspected of having a communicable disease and have not been diagnosed with a communicable disease within the past week.
  3. To the best of my knowledge, I am not likely to infect others through my participation in the Activities.
  4. I am physically fit, do not suffer from any serious or chronic illnesses or conditions, and have no physical or mental disabilities, whether temporary or permanent, that would prevent me from participating in the Activities.
2. For My Minor Student(s):
  1. I confirm that I have obtained all necessary health information and disclosures from the Minor Student(s)' Parent or Legal Guardian regarding any medical conditions, communicable diseases, allergies, or special requirements.
  2. Based on the information provided by the Parent or Legal Guardian, I represent and warrant that the Minor Student(s):
    - Is not currently experiencing symptoms of any communicable disease, including but not limited to COVID-19.
    - Is not suspected of having a communicable disease and has not been diagnosed with a communicable disease within the past week.
    - To the best of my knowledge and that of the Parent or Legal Guardian, is not likely to infect others through participation in the Activities.
    - Is physically fit, does not suffer from any serious or chronic illnesses or conditions, and has no physical or mental disabilities, whether temporary or permanent, that would prevent participation in the Activities.
PERSONAL INFORMATION & PHOTOGRAPHIC RELEASE.
1. Definition of Personal Data: Personal Data includes the Representatives and/or Minor Student(s) name, age, nationality, and photographs.
2. Use of Photographs & Media: I, on behalf of myself and my Minor Student(s), consent to EN-WWF capturing photographs, audio, and video recordings during the Activities. I understand that these may be used by EN-WWF for promotional, educational, and public awareness purposes related to the Activities on EN-WWF’s social media platforms such as LinkedIn, Instagram, EN-WWF’s website, and other marketing channels.
3. Consent for Use: I, on behalf of myself and my Minor Student(s), grant EN-WWF the right to use such media and Personal Data of my Minor Student(s) for the purposes stated above. I understand that this consent is voluntary and that it may be withdrawn at any time by providing written notice to EN-WWF to the email provided in the Privacy Policy. I confirm that I have obtained explicit consent from the Minor Student(s)' Parent or Legal Guardian, as required under applicable UAE law, to authorize EN-WWF's use of the Minor Student(s)' Personal Data and media as described herein.
4. Personal Data Protection: EN-WWF will handle all Personal Data in accordance with EN-WWF’s Privacy Policy.
5. Accuracy of Information: I affirm that the Personal Data provided is accurate and that I have the authority to consent to its use.
BEHAVIORAL CHANGE DATA COLLECTION. I, on behalf of myself and my Minor Student(s), consent to EN-WWF collecting anonymized behavioral data through observational methods during the Activities as part of their behavioral change research methodology. I understand that this data will be used solely for research purposes, both internally and externally, to improve EN-WWF’s programs. I acknowledge that the collected data will be anonymized to protect the identities of both myself and my minor Student(s). Furthermore, I confirm that I have obtained all necessary approvals and consents from the Minor Student(s)' Parent or Legal Guardian to facilitate this data collection.
RELEASE AND WAIVER. TO THE FULLEST EXTENT PERMITTED BY UAE LAW, I, as the Representative and on behalf of the School, release and hold harmless EN-WWF and its directors, officers, agents, employees, representatives, sponsors, successors, and assigns ("EN-WWF Parties") from any and all liability, claims, and demands of whatever kind or nature, either in law or equity, that I or the school as provided under page 1 and its directors, officers, agents, employees, representatives, sponsors, successors, and assigns may have against EN-WWF arising from my own participation in the Activities, including any injury, illness, death, or property damage that may result from such participation, except where such loss or damage is due to the gross negligence or willful misconduct of EN-WWF Parties.
I confirm that the School has already obtained from the Minor Student(s)' Parent or Legal Guardian all necessary approvals and consents required under applicable UAE laws and regulations for their child(ren) to participate in the Activities, including their acceptance and acknowledgment of a Release and Waiver on behalf of their child(ren), which includes a release of EN-WWF Parties from liability to the same extent as provided herein. I, as the Representative, have the proper documentation to prove this and understand that EN-WWF may request such documentation.

I confirm that I am duly authorized by the School to execute this Release on its behalf and on behalf of its directors, officers, agents, employees, representatives, sponsors, successors, and assigns. I understand that EN-WWF may request documentation evidencing such authority.

I further understand that EN-WWF does not assume any responsibility for, or obligation to provide, financial assistance or any other assistance (including but not limited to medical, health, or disability insurance) in the event of injury or illness during the Activities.
FURTHER WARRANTIES. As a Representative, I represent and warrant that I have obtained all necessary approvals from my school or institution to escort and supervise my Minor Student(s) during the Activities. I have obtained all required consents from my Minor Student(s)' Parent or Legal Guardian as required under applicable UAE laws and regulations, including consent for participation, medical treatment, and use of Personal Data. My School has fulfilled its duty to inspect the locations where the Activities will take place, ensuring they are safe and suitable for minor student participation, in accordance with applicable UAE laws, regulations, and school policies. I will perform my duties in accordance with applicable UAE laws and regulations, as well as the policies of my School.
FORCE MAJEURE EVENT. EN-WWF shall not be liable for any failure or delay in performing its obligations under this Release if such failure or delay is caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, extreme weather conditions, or governmental actions. EN-WWF will make reasonable efforts to notify the Representative of such events and, if possible, reschedule the Activities.
GOVERNING LAW. This Release shall be governed by and construed in all respects in accordance with the applicable federal laws of the United Arab Emirates and the applicable local laws in which the Activities are being conducted. Any disputes arising out of or in connection with this Release shall be settled amicably through negotiation. If a resolution cannot be reached, the dispute shall be referred to the courts of Abu Dhabi
ACCEPTANCE. I confirm that I am duly authorized by the School to execute this Release on its behalf and on behalf of its directors, officers, agents, employees, representatives, sponsors, successors, and assigns.
I have carefully read this Release in its entirety, fully understand its contents, and agree to the terms and conditions on behalf of myself, the School, and the Minor Student(s) under my supervision. I acknowledge and understand that substantial rights have been given up by accepting this Release.

I confirm the School has obtained the acceptance and acknowledgment of this Release from my Minor Student(s)' Parent or Legal Guardian, as required under applicable UAE laws and regulations, and that I have the proper documentation to prove this. I, as the Representative, accept this Release freely and agree to be bound by it from the date I click on ‘I Accept’ onward.
